During a plenary session of the European Parliament, MEP Małgorzata Gosiewska spoke in the debate titled “The Significance of EU Legislation That Includes Lack of Consent Among the Elements of the Definition of Rape,” explaining her opposition to the proposed report. She emphasized that her position is not directed against victims of sexual violence, but rather serves to defend the principles of criminal law and the sovereignty of member states.
In her remarks, she noted that opposition to the document does not mean denying the importance of consent in interpersonal relationships. Instead, she pointed out the risks associated with attempting to impose a uniform definition of the crime on all European Union countries, regardless of their legal traditions and experiences.
“A vote against this report is not a vote against victims of sexual violence, nor is it an objection to the importance of consent. It is a vote in defense of sound law, the principles of criminal procedure, and the sovereignty of member states,” said Małgorzata Gosiewska.
The MEP emphasized that criminal law should not be a field for experimentation or centralization. She pointed out that the proposed solutions could lead to a reversal of the burden of proof, increase legal uncertainty, and even hinder victims’ ability to seek justice. She also recalled that there have been cases in Europe where poorly designed changes have resulted in more lenient penalties for sex offenders.
In her speech, she emphasized that effectively combating sexual violence requires concrete actions: the inevitability of punishment, tangible support for victims, effective prosecution of perpetrators, enforcement of sentences, and responsible security and education policies based on mutual respect.
“Europe should be a community of cooperating nations, not a project of centralization in an area as sensitive as criminal law. My vote will be in support of the victims, justice, and the sovereignty of the member states,” she emphasized.
In conclusion, she announced that she would vote in accordance with the arguments presented, advocating for solutions that strengthen the effectiveness of national systems while respecting the competences of Member States.
